Договір публічної оферти

1. Загальні положення

1.1. Цей Договір є публічною офертою (пропозицією) Продавця укласти договір купівлі-продажу товарів на сайті euro-parts.com.ua (далі – Сайт).

1.2. Продавець: [ВКАЖІТЬ: ТОВ "ЄВРОПАРТС УКРАЇНА" або ФОП Прізвище І.Б.], код ЄДРПОУ/ІПН: [ВКАЖІТЬ КОД], адреса: 04080, м. Київ, вул. В. Хвойки, 21.

1.3. Покупець – будь-яка дієздатна фізична або юридична особа, яка оформила замовлення на Сайті.

1.4. Оформлюючи замовлення, Покупець засвідчує, що він ознайомлений з умовами цієї Оферти та повністю погоджується з ними.

2. Предмет договору

2.1. Продавець зобов’язується передати у власність Покупця Товар, а Покупець зобов’язується оплатити та прийняти Товар на умовах цього Договору.

2.2. Право власності на Товар переходить до Покупця в момент вручення товару службою доставки або під час самовивозу.

3. Оформлення замовлення та Ціна

3.1. Замовлення приймаються через Сайт або за телефонами: +380 44 581 56 97, +380 44 290 41 34.

3.2. Ціни на Сайті вказані в гривнях.

3.3. Якщо фактична ціна товару відрізняється від зазначеної на сайті (наприклад, через технічний збій або зміну курсу для імпортних запчастин), Продавець зобов’язаний повідомити про це Покупця для підтвердження або скасування замовлення.

4. Оплата і Доставка

4.1. Оплата здійснюється:

  • Безготівковим розрахунком (для юридичних осіб з ПДВ/без ПДВ);
  • Онлайн-оплатою на сайті (Visa/Mastercard);
  • Накладеним платежем при отриманні (Нова Пошта).

4.2. Доставка здійснюється поштовими операторами (Нова Пошта, Укрпошта) або самовивозом з офісу: м. Київ, вул. В. Хвойки, 21.

5. Повернення товару та Гарантія

5.1. Для споживачів (фізичних осіб): Відповідно до ст. 9 Закону України «Про захист прав споживачів», Покупець має право повернути товар належної якості протягом 14 днів, якщо товар не використовувався і збережено його товарний вигляд.

5.2. Для бізнесу (B2B/Сервісних центрів): Повернення товару належної якості юридичними особами можливе лише за погодженням з Продавцем або у випадку, передбаченому окремим договором поставки.

5.3. Гарантійний термін зазначається в гарантійному талоні або описі товару.

5.4. Витрати на доставку при поверненні товару належної якості несе Покупець.

6. Відповідальність сторін

6.1. Продавець не несе відповідальності за незначні відмінності в колірній гамі товару, що можуть залежати від налаштувань монітора Покупця.

6.2. Спірні питання вирішуються шляхом переговорів. У разі недосягнення згоди спір вирішується згідно з чинним законодавством України.

English translation of the Public Offer

1. General Provisions

1.1. This Agreement is a public offer of the Seller to conclude a purchase and sale agreement for goods on the website euro-parts.com.ua (hereinafter referred to as the "Website").

1.2. Seller: [INSERT: LLC "EUROPARTS UKRAINE" or Sole Proprietorship Name], EDRPOU/Tax ID: [INSERT CODE], address: 21 V. Khvoiky St., Kyiv, 04080.

1.3. Buyer: any legally capable natural person or legal entity placing an order on the Website.

1.4. By placing an order, the Buyer confirms that they have read and fully agree to the terms of this Offer.

1.5. Note: This document is a translation of the Ukrainian "Public Offer". In case of discrepancies between the Ukrainian and English versions, the Ukrainian text shall prevail.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer the ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

2.2. The ownership of the Goods passes to the Buyer at the moment of delivery by the courier service or during pickup.

3. Order Processing and Price

3.1. Orders are accepted via the Website or by phone: +380 44 581 56 97, +380 44 290 41 34.

3.2. Prices on the Website are indicated in Ukrainian Hryvnia (UAH).

3.3. If the actual price of the goods differs from that stated on the website (e.g., due to technical error or exchange rate fluctuations for imported parts), the Seller is obliged to inform the Buyer to confirm or cancel the order.

4. Payment and Delivery

4.1. Payment can be made by:

  • Bank transfer (for legal entities with VAT/without VAT);
  • Online payment on the website (Visa/Mastercard);
  • Cash on delivery upon receipt (Nova Poshta).

4.2. Delivery is carried out by postal operators (Nova Poshta, Ukrposhta) or by pickup from the office: 21 V. Khvoiky St., Kyiv.

5. Returns and Warranty

5.1. For Consumers (Individuals): In accordance with Art. 9 of the Law of Ukraine "On Protection of Consumer Rights", the Buyer has the right to return goods of proper quality within 14 days, provided the goods have not been used and their marketable condition is preserved.

5.2. For Business (B2B/Service Centers): Return of goods of proper quality by legal entities is possible only upon agreement with the Seller or in cases provided for by a separate supply contract.

5.3. The warranty period is specified in the warranty card or product description.

5.4. Shipping costs for returning goods of proper quality are borne by the Buyer.

6. Liability of the Parties

6.1. The Seller is not responsible for minor differences in the color scheme of the goods, which may depend on the Buyer's monitor settings.

6.2. Disputes shall be resolved through negotiations. If no agreement is reached, the dispute shall be resolved in accordance with the current legislation of Ukraine.
